Terms and Conditions

Payment: The Client shall pay in full and any additional services incurred the day the photography services are rendered.  All reprint orders require a 50% deposit with the remaining balance due upon delivery of final prints. If Client defaults on said final print order, the photographer has the right to retain the 50% deposit and take legal action if necessary.

Satisfaction Guarantee: Colbert Portraits guarantees complete satisfaction of our professional previews and prints.

Photographic Materials: All photographic materials, including but not limited to digital negatives and original previews, shall be the exclusive property of the Photographer.

NOTICE OF COPYRIGHT and Reproduction: It is illegal for anyone other than photographer to copy or reproduce said photographs elsewhere without first obtaining Photographer’s written permission and violators of this law will be subject to its civil and criminal penalties. The Photographer shall own the copyright on all images created and shall have the exclusive rights to make reproductions. The Photographer shall only make reproductions for the Client or for the Photographer’s portfolio, samples, self-promotions and advertising, entry in photographic contests or art exhibitions, editorial use, or for display within or outside of the Photographer’s studio. If the Photographer desires to make other uses, the Photographer shall not do so without the written permission of the Client.

Client’s Usage: The Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than the Photographer. If Client is obtaining print for reproduction, Photographer authorizes Client to reproduce the print only as set forth by Special Usage Addendum in the contract. In such event, Client shall request that a credit for the Photographer be placed adjacent to the photograph on the publication. A copy of this request must be submitted to the Photographer.

Limited Liability: If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God or other cause beyond the control of the parties involved, or due to illness of Photographer, then any unused deposit will be returned to the Client but shall have no further liability with respect to the Agreement. If the Client wishes, another sitting can be scheduled. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In such cases of outside circumstances, the Photographer is not liable. Cancellations will be acceptable and payable in full if notified within 72 hours of assigment. Otherwise, 50% of the contract retainer will be charged.

Your proofs are not retouched and should be viewed for pose and expression only. Retouching includes softening to minor blemishes and puffiness under the eyes. Your finished photographs will be professionally color corrected to make the best image possible.
